Terms and Conditions of Service

The offer and sale of products on our website "www.lakshmi.it"are governed by these Terms of Sale, valid for every proposal, order, and order confirmation for the purchase of products. The confirmation of the order by the Customer constitutes acceptance of these terms of sale."

 

TIMES AND PRICES

Purchase Method. Before placing the purchase order, the customer is required to read the general conditions. Submitting the order implies their automatic acceptance. The customer purchases the product, the characteristics of which are illustrated online in the relevant sheets, at the indicated price, to which shipping costs are added as stated on the website. Before confirming the purchase order, the unit cost of each selected product, the total cost in case of purchasing multiple products, the cost of additional expenses based on the selected payment method, and the amount of shipping costs will be summarized. Once the purchase order is confirmed, the customer will receive an email confirming the receipt and acceptance of the order, containing all the information about the purchased products, a detailed indication of the price, shipping costs, applicable taxes, payment methods, and information on the right of withdrawal. With the sending of the confirmation email, the purchase contract is considered concluded and formalized. Lakshmi it reserves the right not to accept or process orders that are incomplete or missing essential data.

Delivery times and methods. Lakshmi will deliver the selected and ordered products to the Customer using the methods specified in the previous article via BARTOLINI. The delivery times, according to Article 6 of Legislative Decree No. 206/2005, are on average 3 days and do not exceed 30 days from the day following the transmission of the order. The invoice will be included in the shipped package, using the data entered by the Customer during the registration phase on the website. To this end, we recommend entering your Tax Code.

Prices and product details. All selling prices of the Products available on the website are expressed in Euros and include VAT and any other taxes. Any promotions are to be considered valid only for the online store. The prices applied are those indicated on the Website at the time of the Customer's purchase order. The prices of the products published from time to time cancel and replace the previous ones and are subject to the actual availability of the products. The images of the products are for illustrative purposes only.

PAYMENT, TRANSPORT AND DELIVERY MODALITIES

Paypal: the customer can make the payment through the Paypal network, using a personal Paypal account or choosing not to register for the Paypal service. In the event that the payment is not made within 2 days from the date of the order, unless otherwise agreed between the customer and Lakshmi.it, the order will be canceled without any notice. With the Paypal system, it is also possible to pay with Visa and MasterCard credit cards. No additional fees are charged.

Visa and MasterCard credit card: the customer can make the payment via credit card, the amount will be charged only after completing the purchase. No additional fees are expected.

 

TRANSPORT

The goods travel at the buyer's expense and risk: Lakshmi.it will therefore not be responsible for any delays or damages resulting from transportation. In the event that the package arrives visibly damaged, please accept the package by signing with reservation; otherwise, it will not be possible to request any refund. In the event of a package refusal, Lakshmi.it may charge the customer the full amount of shipping costs and the cost incurred for returning the package to the sender. The delivery terms indicated by Lakshmi.it refer to products available in stock and are to be understood as non-binding since they may be modified by Lakshmi.it in case of actual needs. Lakshmi.it reserves the right to deliver products related to the same order in multiple shipments without further charges to the customer. Special conditions and delivery terms must be agreed upon in advance via email or by phone between the Customer and Lakshmi.it and accepted by both parties. Any special offers or promotions proposed by Lakshmi.it are valid until their expiration or until the products subject to the promotion are sold out.

 

SHIPPING

For shipments in Italy Lakshmi.it requires a contribution of € 5.90 including VAT for orders up to € 58.99. From € 59.00 onwards, shipping costs are free. The promotion is valid only for purchases in Italy. 

PRODUCT WARRANTIES

Lakshmi.it guarantees the sole material integrity of the products at the time of delivery. Any defects must be reported by the customer, under penalty of forfeiture, within and no later than 10 (ten) days from the date of delivery. The customer is entitled to the replacement of damaged products upon their return, excluding the customer's right to compensation for any damage, including further damage. The shipping costs necessary for the replacement of products are to be borne by the customer. Lakshmi it does not provide any additional warranty on the products beyond that provided by the individual manufacturers. Save for cases of fraud or gross negligence by Lakshmi it, it is agreed that the liability of Lakshmi.it shall not exceed the price of the products purchased by the customer that are subject to dispute.

 

RIGHTS OF WITHDRAWAL

The Customer has the right to withdraw from the contract and to return the ordered products within 14 (fourteen) working days from the receipt of the products themselves. The right of withdrawal must be exercised by the Customer, under penalty of forfeiture, by sending a registered letter A.R. to Lakshmi Srl, VAT number. 02952110233 based in Via Fior di Loto, 1 – 37021 Bosco Chiesanuova Verona within the time limits set by law. The Customer cannot exercise the right of withdrawal for personalized or bulk products. The refund will be made as soon as possible, and in any case within 30 days from the date on which Lakshmi.it is informed, in the manner described above, of the exercise of the right of withdrawal by the Customer. The Customer is required within 30 (thirty) working days from the exercise of the right of withdrawal, to send the returned Products to the address of Lakshmi.it, with traceable shipping and shipping costs borne by the Customer.

GOVERNING LAW AND DISPUTE RESOLUTION

The General Conditions of Sale are governed by Italian law and in particular by Legislative Decree No. 206 of September 6, 2005, regarding distance contracts and by Legislative Decree No. 70 of April 9, 2003, on certain aspects concerning electronic commerce. In the event of disputes between Lakshmi Srl and each end user arising from the General Conditions of Sale, the competent court is that of VERONA.

 

MODIFICATION AND UPDATE

The General Terms and Conditions of Sale are modified from time to time also in consideration of any regulatory changes. The new General Terms and Conditions of Sale will be effective from the date of publication on www.lakshmi.it
